DECISION
Establishment of Project Management Unit for the Le Trong Tan New Township investment and construction Project, developed by Vietnam International Township Development JSC
GENERAL DIRECTOR
VIETNAM INTERNATIONAL TOWNSHIP DEVELOPMENT JSC
- Based on Investment Certificate No. 031032000204 dated 4 March 2008 by People’s Committee of Ha Tay Province (Ha Tay Province now belongs to Hanoi) regarding establishment of Vietnam International Township Development JSC to implement the Le Trong Tan New Township investment and construction project, Ha Dong City, Ha Tay Province;
- Based on Law on Construction No. 16/2003/QH dated 26 November 2003 By National Assembly of Socialist Republic of Vietnam;
- Based on Decree No. 12/2009/NĐ-CP dated 10 February 2009 by the Government regarding management of investment and construction project;
- Based on Circular No. 03/2009/TT-BXD dated 26 March 2009 by Ministry of Construction regarding “Detailed stipulation on some contents of Decree No. 12/2009/NĐ-CP dated 10 February 2009 by the Government regarding management of investment and construction project”;
- Based on Regulations on organization and operation of Vietnam International Township Development JSC (VIDC).
DECIDE:
Aticle I: Establish Project Management Unit for the Le Trong Tan New Township investment and construction project, Ha Dong developed by Vietnam International Township Development JSC (hereafter referred to as PMU for short).
PUM shall use stamp of VIDC during work implementation;
PMU realizes functions and missions of the Developer in terms of management of implementing the Le Trong Tan New Township investment and construction project, Ha Dong.
PMU operates in accordance with Regulations on management of investment and construction issued with Decree No. 12/2009/NĐ-CP dated 10 February 2009 by the Government regarding management of investment and construction project and current regulations and stipulations by Vietnamese State and VIDC;
Article II. Rights and responsibilities of PMU:
PMU shall realize rights and responsibilities of of the Developer in terms of management of implementing the Le Trong Tan New Township investment and construction project, Ha Dong. Responsibilities are as follows:
1. To prepare the investment and construction project:
- To realize rights and responsibilities at Articlie 41 of Law on Construciton; Article 34 of Decree No. 12/2009/NĐ-CP dated 10 February 2009 by the Government regarding management of investment and construction project;
2. To manage investment and construction project:
- To realize procedures regarding land hand-over, land receiving, preparation of construction site and other works which serve project construction. To be the key contact with local authorities and relevant authorities during project implementation;
- To prepare design document, cost estimate, overall estimate of project construction so that the Developer can organize verification, approval;
- To prepare tender document, to organize contractor appointment;
- To negotiate, to sign contract with contractor and consultant as authorized by the Developer;
- To inspect, pay and balance in accordance with signed contract;
- To control quality, quantity, progress, cost of construction, environmental saniation of the project;
- To inpect and implement site hand-over;
- To prepare balance report on the project when the project is completed.
3. To implement other missions as assigned by the company.
Article III: Organization and personnel:
1. Leaders of PMU: Include one Project Director and other Deputy Project Directors as appointed or dismissed by General Director of VIDC.
PUM Director shall manage and control all activities of PMU and shall be completely responsible to the company and legally for all activities of PMU.
Deputy Director shall assist Director to carry out works assigned by Director and shall be responsible to the Director and legally for missions assigned and authorized.
2. Supporting system for the Director includes:
- Project Management Departments (includes project management department, design department and cost and contract department);
- Department of Accounting and Finance;
It depends on actual situation of each stage of project implementation to arrange number of staffs for professional departments appropriately, to ensure fulfillment of assigned missions.
Article IV: To assign PMU to compile regulations on organization and operation which will be submitted to General Director of VIDC for approval.
Article V: VIDC, related departments and individuals are responsible for execution of this Decision.
This Decision is effective since the date of signing. /.
